Enrollment Agreement and Terms of Service: a legal and binding contract pursuant to which the student and Giselle Real-d’Arbelles, AKA, “Giselle World” will adhere to the rules, policies, regulations and agreements for “Beauty Way Vocal Healing Apprenticeship” with Giselle World. By signing up for this program, you agree to these terms.

This Program Agreement (“Agreement”) sets forth the terms and conditions of your (“you” or “student”) use of the products and services offered by Giselle World, “Beauty Way Vocal Healing Apprenticeship” (“The Program”). By enrolling in this Program you confirm your acceptance of these agreements, including the arbitration, class-action waiver, and limitation of liability provisions contained in the Agreement.

1. Services. Students who have accepted the Agreements will have a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access the Program, which will be led online via zoom with some group sessions recorded, and occasional content information shared via our private Whatsapp group. Students may access the Program only for your personal, non-commercial use. Students agree not to share access to the Program with any third-party or post it online, social media, etc in any capacity, with the exception of paragraph or less excerpts with proper credit and quoting to Giselle World. They agree not to quote any part of the content without full reference to Giselle World. Accessing the Program does not give students ownership of any intellectual property rights in the Program.

2. Tuition and Fees. The student agrees to pay in full and on time via the Payment Plan or Payment-in-Full noted above. A student who fails to make a timely payment under a Payment Plan, may be charged additional fees, which is subject to change. A student who fails to make a timely payment and/or fails to pay the total Program Cost is not in good financial standing until all unpaid amounts are cured and may, in The Program’s sole discretion, be suspended or withdrawn from the Program, and other products and services, and have their outstanding payments accelerated. The Program may either remove students from the course or refer a student to a collections agency if a payment is not received within sixty (60) days of being due, and the student may be subject to costs and charges imposed by any such collection agency.

3. Non-Disclosure: To ensure that the public receives consistent and accurate information about The Program products and services, you agree not to publish, advertise, or otherwise disclose the Program Cost anywhere or to anyone..

4. Conduct. Participants are to exercise kindness when engaging in The Program group(s). We reserve the right to withdraw access to the program without any refund to anyone using abusive or disparaging language to another participant or the teachers. We are a container of mutual respect and equanimous conflict resolution. 

a. Confidentiality: At times, students may be invited and encouraged to share personal and/or private information with the circle. You agree not to disclose this information to others or disclose the names of other participants. We reserve the right to withdraw access to the program without any refund to anyone who discloses personal or private information within the circle.

b. Non-Compete: You acknowledge that The Program has invested extensive resources into developing the Program. By enrolling in the Program, you gain access to confidential information that constitutes The Program’s proprietary materials and methods. As a result, your use of this information to compete with The Program would be unfair and would violate The Program’s, subject to immediate release from The Program.

c. Non-Disparagement: You agree not to disparage The Program or any of the other students who are enrolled. For purposes of this section, “disparage” shall mean any negative statement, whether oral or written, whether in print or electronic form, including, without limitation, on any Internet site or web application such as Facebook, YouTube, Instagram, Twitter, chat forums, communities, and/or message boards.

d. Intellectual Property: You acknowledge and agree that the Program and any resources or materials relating to the Program constitute the sole and exclusive property of The Program. You agree not to reproduce, copy, duplicate, distribute, lend, sell, or otherwise transfer or disclose to any other individual or party, the Materials, without the express prior written consent of The Program. In the event that you are licensed or otherwise authorized to use any Materials, you agree to name The Program as your source of information and site the “Beauty Way Vocal Healing Apprenticeship” as your music method.

e. Program Technology. The Program will be made available online. You are solely responsible for ensuring that you have the appropriate hardware, software, Internet access, and/or other equipment necessary to participate in the Program.

5. Indemnification. You agree to indemnify, defend, and hold harmless The Program and its affiliates, members, and owners, against any and all claims, actions, demands, liabilities, losses, damages, judgments, settlements, costs, and expenses, including reasonable attorneys’ fees and costs, (collectively or individually, ‘Losses’) insofar as such Losses arise out of or are based upon:

a. Your performance of, or failure to perform under, the agreements;

b. Your lack of attendance to private and group sessions

c. Your breach of any representation, warranty, or obligation under the agreements;

d. Your improper use of program materials;

e. Bodily injury, death of any person, or damage to any personal property resulting from your acts or omissions; and

f. Your violation of any copyright, patent, trade secret, trademark, and/or other intellectual property right of any person.

6. Limitation of Liability. In no event shall The Program’s liability arising out of or related to the Program or this Agreement, whether in contract, tort, or any other theory of liability, exceed the Program Cost paid by you and received by The Program at the time of the first instance of the event giving rise to the liability. Notwithstanding and subject to the foregoing, exemplary, or special damages of any kind or nature however caused, whether in contract, tort, or any other theory of liability.

7. Term and Termination. This Student Agreement shall become effective once signed by all parties. The Program may terminate the Program, at any time, for any reason. If the Program is terminated following your enrollment, but prior to your completion of this Program, you shall be entitled to a prorated credit of the Tuition and Fee amounts you have paid at the time of termination in accordance with your Enrollment Agreement, transferable to future programs.

8. Representations, Warranties, and Disclaimers.

a. You represent and warrant that you have the legal power to enter into this Agreement.

b. You represent that you have reviewed and evaluated this program agreement and acknowledge that:

i. You have read the agreements as detailed in this document and understand them;

ii. The Program will not train you to become a medical doctor, psychologist, psychotherapist, nutritionist, or dietician;

iii. Each jurisdiction has its own laws and regulations regarding the provision of services by medical doctors, psychotherapists, psychologists, nutritionists, and dietitians and you are solely responsible for ensuring that your practice does not violate any jurisdiction’s laws or regulations;

9. Attendance and Make Ups. It is the responsibility of the student to show up for each private and group session. Any group session missed is a forfeited session. The student may only catch the missed group session via a recorded zoom link. It is the student’s responsibility to keep up with the course materials and assignments.

• Agreement to be fully present and with your video on for the group sessions. It is a very intimate and sensitive space and only fully works with everyone 100% present.

10. Relationship of the Parties. No part of this agreement creates a partnership, franchise, joint venture, agency, fiduciary, or employment relationship between you and The Program. You do not have the authority (and shall not hold yourself out as having the authority) to bind The Program to any agreements.

11. Waiver and Cumulative Remedies. No failure or delay by The Program in exercising any right under the Agreements shall constitute a waiver of that right.

12. Force Majeure. The Program is not responsible for delays or failures to perform its responsibilities under these Agreements due to causes beyond its control, including but not limited to acts of God, acts of government, flood, fire, earthquakes, tornadoes, civil unrest, acts of terror, pandemics, strikes or other labor problems, computer, telecommunications, internet service provider or hosting facility failures or delays involving hardware, software or power systems, malicious code, denial of service attacks, and inability to obtain energy.

13. Entire Agreement. The agreements in this document constitute the entire agreement between you and The Program regarding the Program and supersede all prior and contemporaneous agreements, proposals or representations, written or oral, concerning the Program. No modification, amendment, or waiver of any provision of these agreements shall be effective unless in writing and signed by you and The Program.

14. Acknowledgement of Self-Contract.

In committing to the Program, you agree to the following:

- Devotion to our time together- understanding that you are participating in this apprenticeship as an immersion in the voice and ritual arts, and will devote your time and energies to give full priority to this training, practicing self-responsibility & compassionate ownership of your emotions, thoughts, and actions, consistent engagement in self-study & self-awareness, and open contribution to the overall group experience.

- Full participation in each session- Punctuality, participation/availability, showing up in a respectful, present & self-aware manner, demonstration of aptitude & capacity for facilitation/space-holding will ensure successful completion of this program.

15. - MODIFICATIONS TO THE SERVICE AND PRICES

Prices for this program are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

16. - OPTIONAL TOOLS

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through the site or group chat is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

By enrolling in “Beauty Way Vocal Healing Apprenticeship” with Giselle World, you agree to the above terms of Service.
